When Spousal Sponsorship Faces Obstacles: How Should H&C Relief Be Requested?
- 哪一项规定构成申请障碍;
- 请求豁免的具体要求及法律依据;
- 家庭关系、子女利益和个人困难有哪些证据支持;

When Spousal Sponsorship Faces Obstacles: How Should H&C Relief Be Requested?
In complex spousal sponsorship cases, applicants often ask: “If I cannot meet the regular requirements, can an officer consider humanitarian and compassionate (H&C) grounds?”
The first questions are how the request should be made and which specific requirement needs to be waived.
Different Procedures Require Different Analysis
On October 6, 2026, IRCC made minor updates to its instructions on consecutive and concurrent H&C applications. This was not a new immigration program or an announcement of broadly relaxed eligibility requirements.
The instructions explain that a standalone H&C application will generally be held in abeyance while an inland spousal sponsorship application is pending. If the sponsorship application is ultimately refused, processing of the outstanding H&C application may resume under standard procedures.
This arrangement should not automatically be applied to an H&C request made within a sponsorship application. The instructions separately address restrictions on concurrent H&C requests. The applicable intake rules and the nature of the requested relief require careful examination.
Personal Hardship Must Be Connected to a Clear Request and Supporting Evidence
For cases involving undeclared family members, class eligibility or previous refusals, simply asking for “humanitarian consideration” may not adequately explain the relief sought.
A carefully prepared submission should identify:
- The provision creating the obstacle;
- The specific exemption requested and its legal basis;
- Evidence of family relationships, the best interests of affected children and personal hardship;
- Whether the submissions are consistent with previous immigration records.
Where an applicant has already received an H&C assessment, a subsequent application should explain any new circumstances and evidence. IRCC may consider earlier information and findings, but must also consider new information submitted with the latest application.
A complex case requires more than an additional explanation letter. The legal obstacle, procedural approach and supporting evidence must work together.
